Terms of Service

1. Eligibility & Accounts

• You must be at least 18 years old and authorised to act on behalf of your business.
• You are responsible for safeguarding your login credentials and for all activity under your account.
• Provide accurate information and keep it updated, including brand/retailer profile details.

2. Acceptable Use

• Do not scrape or harvest data at scale, circumvent security, or interfere with the Platform.
• Do not post illegal, infringing, misleading, or harmful content.
• Respect others' privacy and intellectual property rights.
• We may rate‑limit, suspend, or terminate accounts that violate these Terms.

3. User Content & Licences

You retain ownership of content you submit. You grant Stokmark a worldwide, non‑exclusive, royalty‑free licence to host, store, reproduce, and display your content solely for operating and improving the Platform. You represent you have all rights necessary to grant this licence and that your content does not infringe others' rights.

4. Third‑Party Services

The Platform integrates third‑party services (e.g., Supabase, Vercel, Resend, Google OAuth). Their use is subject to those providers' terms and privacy policies.

5. Fees

If we introduce paid features or plans, applicable fees and terms will be presented within the Platform or at checkout. Unless stated otherwise, fees are non‑refundable except as required by law.

6. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non‑infringement. We do not warrant that the Platform will be uninterrupted, secure, or error‑free.

7. Limitation of Liability

To the maximum extent permitted by law, Stokmark and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Platform.

8. Termination

You may stop using the Platform at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, certain provisions that by their nature should survive will do so (e.g., licences, disclaimers, limitation of liability).

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in South Africa.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date above. Material changes may be communicated via the Platform or email.
